Terms of Service

1. Agreement

By accessing or using TrulyForged software and services (the "Service"), operated by Truly Forged LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Description of Service

TrulyForged provides cloud-based daycare management software including an admin portal, a guardian mobile app, and a staff/classroom mobile app. Features include attendance tracking, activity logging, family messaging, staff management, compliance reporting, and payment processing facilitation.

3. Subscription and Billing

Access to TrulyForged requires a paid subscription after the free trial period. Subscription fees are billed monthly in advance via Stripe. You authorize us to charge your stored payment method on the billing date each month. Prices are subject to change with 30 days' notice.

A free 30-day trial is provided to new accounts with no payment required. At the end of the trial, a subscription must be activated to continue access. We reserve the right to suspend access to accounts with outstanding balances.

4. Payment Processing

Tuition payments collected through the platform are processed by Stripe. A per-transaction handling fee applies to each tuition payment. We do not store full payment credentials — all payment data is managed by Stripe in compliance with PCI-DSS standards. You are responsible for ensuring your families are informed of any applicable fees.

5. Free Trial

New accounts receive a 30-day free trial with full access to all features. No credit card is required to begin a trial. We reserve the right to modify or discontinue trial offers at any time.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with applicable regulations, including but not limited to FERPA, COPPA, and Florida DCF licensing requirements. You may not use the Service to store data that you are not authorized to collect, to harass or harm any person, or to interfere with the operation of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you submit to the Service. You grant us a limited license to process that data solely to provide the Service.

You are responsible for maintaining the accuracy of data entered into the platform and for obtaining all necessary consents from families and guardians to collect and process their information.

8. Intellectual Property

The TrulyForged software, design, and content are owned by Truly Forged LLC and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Availability and Support

We will make reasonable efforts to maintain Service availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. Support is provided via email at consult@trulyforged.com.

10. Limitation of Liability

To the maximum extent permitted by law, Truly Forged LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or business interruption. Our total liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

11. Termination

Either party may terminate the subscription at any time. Upon termination, your access will end at the close of the current billing period. We will retain your data for 30 days post-termination, after which it may be permanently deleted. You may request an export of your data before termination by contacting us.

12. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
